These Terms and Conditions (“Terms”) govern your access to and use of emccommercialgroup.com (the “Site”) and the informational services provided by EMC Commercial Group (“EMC,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. About EMC Commercial Group
EMC Commercial Group is a Texas-based government contracting firm providing real estate, property management, facilities, lodging, and travel support services to federal, state, and local government agencies. Our principal place of business is 4236 Waterstone Rd #100, Keller, TX 76244.
2. Acceptable Use
The Site is provided for general informational purposes about EMC, our capabilities, NAICS codes, certifications, and past performance. By using the Site, you agree to:
- Use the Site only for lawful purposes
- Not interfere with the Site’s operation, security, or accessibility
- Not attempt unauthorized access to any portion of the Site, systems, or networks
- Not transmit malware, viruses, or harmful code

Information presented on the Site, including capability statements, NAICS codes, past performance summaries, and qualifications, is provided for marketing and business development purposes. This information:
- Is not an offer to enter into a contract
- Does not create any binding obligation on EMC or the user
- Is subject to verification through official channels, including SAM.gov and direct due diligence
- May change without notice as registrations, certifications, or capabilities evolve
Government solicitations must be responded to through official agency channels, including SAM.gov and agency-specific procurement portals. Communications through this Site do not constitute formal proposal submissions.
5. Past Performance
Past performance examples shown on the Site illustrate the types of work EMC has delivered. Specific contract details, client identities, and outcomes may be summarized, redacted, or anonymized to protect client confidentiality and comply with applicable nondisclosure obligations. Past performance is not a guarantee of future results.
6. Government Contract Terms Govern
If EMC enters into a contract with a government agency or prime contractor, the terms of that written contract, including any incorporated FAR or DFARS clauses, govern the relationship and the services provided. Nothing on the Site supersedes or modifies the terms of any executed contract or solicitation.
7. Third-Party Links and Resources
The Site contains links to third-party websites including SAM.gov and agency portals. These links are provided for convenience. EMC does not control and is not responsible for the content, policies, or practices of third-party sites. Inclusion of a link does not imply endorsement.
8. No Warranty
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. EMC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EMC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF EMC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EMC’S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
This limitation does not apply to obligations imposed under any executed government contract, which are governed by the terms of that contract and applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless EMC and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and share information.
12. Modifications
EMC may modify these Terms at any time by posting the revised Terms on the Site. Changes are effective when posted. Continued use of the Site after changes constitutes acceptance of the revised Terms. We encourage you to review the Terms periodically.
13. Governing Law and Forum
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.
This provision does not apply to disputes governed by federal law, by the terms of an executed government contract, or by required forums under the Contract Disputes Act of 1978 (41 U.S.C. § 7101 et seq.) or the Tucker Act (28 U.S.C. § 1491).
14. Federal Government Users
If you are accessing the Site as an employee or representative of the U.S. federal government, you may be subject to additional restrictions under federal law, agency ethics rules, or your employment terms. Your use of the Site does not constitute endorsement of EMC by your agency or by the federal government.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and EMC regarding the Site. They supersede any prior agreements regarding Site use. They do not supersede the terms of any executed government contract or written agreement between you and EMC.
